Carmarthen man fined for overgrown garden
A Carmarthen resident has been prosecuted for ignoring an enforcement notice to clear up his overgrown garden.
On August 22 last year Carmarthenshire County Council served a notice under Section 215 of the Town & Country Planning Act 1990 for Michael Henry Jones to clear the overgrown garden at the rear of his property in Priory Street, Carmarthen.
The property is within a Conservation Area and the overgrown garden affects the amenity of the neighbouring properties. The time limit for compliance has been extended twice and although some works were undertaken the garden has not been fully cleared so as to comply with the requirements of the notice.
A case was brought against Mr Jones in respect of a breach of Section 215 of the Town and Country Planning Act. He failed to attend the hearing at Carmarthen Magistrates Court and the case was proven in his absence.
He was fined £200 and ordered to pay £194.78 costs and £15 victim surcharge.
The council’s executive board member with responsibility for planning enforcement Cllr Jim Jones said: “This case shows that the council will take action if people ignore enforcement notices.
“The notice was issued because the state of the garden was affecting the neighbours and it is important that action is taken to put it right.”
